Is a permit required to Prune or Remove a Tree from Private Land Enquiry

Recent updates to the Victoria Planning Framework have introduced differences between the Planning and Local Law tree protection criteria.

As a result, please advise customers to consult with the planning department first to receive the appropriate guidance before contacting Local Laws.

Is a permit required to remove a tree from Private Land?

Yes, a Local Law or Planning permit may be required to remove any tree on private land.

The initial assessment will be conducted by the Planning Department

If a Planning permit is not required but a Local Law permit is, the Planning Department will provide the customer with the relevant Local Law application form.

  • For the initial enquiry direct the customer to Level 3 to discuss with the Planning Department. They will determine if they need a planning or local law permit.

 

Initial enquiry by phone, Springvale and Parkmore Counter

CSO:

  • Transfer the call to the Planning & Design General - If busy or no answer then:

    Complete Merit
    Planning and Design > General Statutory Enquiry > General Planning Advice

  • UDF Question: What is the enquiry about?
    Answer: Remove tree/native vegetation

    Add in the Description box the reason they wish to remove the tree.
     
  • The customer will be contacted within 1-2 business days

Is a permit required for pruning a tree on private land?

A permit is not required for pruning, so long as the following conditions are met:

  • The pruning is carried out by a qualified arborist in accordance with Australian Standard AS 4373–2007 Pruning of amenity trees and the Arborist has provided their qualifications
  • The property owner has kept photographs of trees before and after the work
  • In an emergency, where any part of a tree is an immediate hazard to life and or property, as determined by a minimum AQF Level 5 Arborist.

If the customer has received the Tree Protection form and requires assistance completing it.

Customer submitted a Tree Protection Application form provided by Town Planning over 7 days ago

If the customer indicates they submitted a Tree Protection Application form provided by Town Planning, as it was determined they needed a Local Law permit, but they have not received any updates.
