Infringements/fines Enquiries

Infringement notices, more commonly known as fines, are penalties for offences contrary to Legislation and Council’s Local Law

  • Parking fines issued under the Road Safety Road Rules 2017 Note: VicRoads sets the rules and council enforces them. The road rules are on the Vic Roads website if they wish to view them.
  • Building and Planning fines issued by Planning Compliance Team
  • Local Law fines
  • Health, Food and Prescribed Accommodation fines
  • Domestic Animal fines
  • Tree Protection Infringements 


If you receive an infringement notice, you have three options:

  • Pay the infringement or enter into a payment arrangement (payment arrangement form must not be given to the customer, we have to complete it for them)
  • Dispute the notice by asking for a review
  • Have the offence dealt with in court

Advising due date for fines

When a customer asks what the due date for my fine?

CSO: STOP, do not provide due date until you have checked the following:

Have they appealed?

No  – Provide the due date listed in P & R.
Yes - but the appeal was declined – Check the alert for the due date, as this is what the customer received in their letter of decline. The date shown in P & R is two weeks later, but it is not the customer's due date.

Request an appeal to review the fine

If they believe the fine is wrong. They can submit one request for review.

CSO

Ask if they have an email.

If Yes

  • email the online review form to the customer
  • supporting documents can be uploaded when completing the form.

Eligible for a payment arrangement:

    Call CommAmenity Admin first to reinstate. Then, you can complete a payment arrangement. If they are busy or unavailable, email Regserv with the customer's details and inform them of the request. They need to activate the fine first and will contact the customer to finalize the arrangement.

Note: 

  • After we receive the review, the fine goes on hold. Even if the expiry date is due, the infringement remains on hold until they receive the outcome
  • They can complete it in a different language. We will get it translated, but we will respond in English. They will need to get it translated.
  • It is required that they use the online form, but if they don't have an email, then they need to complete Internal Review Form below
  • the online review must be submitted by the due date to avoid further costs or escalated to Fines Victoria
  • The council aims to provide a reply within 15 working days however the Infringements Act 2006 allows up to 90 days for a response.

What if the customer does not have email?

    • Full name and postal address 
    • Infringement number
    • Vehicle registration number associated with the fine
    • Explanation of why you believe the fine should be reviewed
    • Any documents that support the appeal need to be included
  • Stamp and photocopy supporting documents related to the appeal
  • Provide a copy for the customer
  • Scan to Records

Can you pay the infringement and then appeal the fine?

Ans: No, they need to appeal first and wait for the outcome before making a payment.

Can you submit the payment arrangement and then appeal the fine?

Ans: No, they need to appeal first and wait for the outcome before a payment arrangement can be submitted.

What if the customer doesn't know how to upload supporting documentation

Ans: If certificates or letters need to be included with the appeal, and a person cannot upload the supporting documentation, they can send or bring in their hard copies to one of our customer service centres. This may include photographs of these documents. If documents are sent via mail, include the infringement/ticket number and registration of the vehicle if the infringement is for parking infringement.

Cheques sent by post are no longer available to pay infringements.
They can present in person at the centers to pay if they wish to pay by cheque 

 

Mail
When processing mail at Dandenong, you can receipt a fine if the enclosed cheque covers the full payment.

Written Off status due to Interstate plates or NAT (national heavy trucks)

Infringements with Written Off status due to Interstate plates or NAT (national heavy trucks)

When infringements issued to interstate and NAT (national heavy trucks) registration plates reach the courtesy letter stage, the council has no choice but to write off the debt because we cannot obtain the owners' details from the road authority of other states. The same applies if we receive a fine with Victorian pages in another state.

 

However, some customers may be unaware of this loophole and attempt to pay the fine, not realising it has already been written off.

Do not inform them of the write-off. Instead, confirm they wish to proceed with the payment.

Then, contact CommAmenity Admin to request the fine be reinstated. Once it’s reinstated, you can receipt the payment.

If the team is busy or unavailable, email CAAdmin@cgd.vic.gov.au with the customer's details and advise of the payment request. CommAmenity will reactivate the fine and contact the customer to let them know they can call back to make payment.

Payment Arrangement/Payment Plan

CSO:

  • First, go to Property and Rating to check if they are eligible  
  • Complete the online payment arrangement form for the customer (THIS FORM IS NOT TO BE EMAILED TO THE CUSTOMER TO COMPLETE)
  • The referral will be sent to Fines Victoria who will contact the customer directly to make the arrangement.

Eligible for a payment arrangement:

  • Courtesy Letter
  • Pending VicRoads
  • Issued or overdue (select "issued" if overdue in the payment arrangement form)
  • NOMD - Re-issued to the nominated driver
  • PayExt - Extension of time (check infringement events for driver nomination)
  • Pending Decision - If the customer has received the outcome and it advises that they are still required to pay the fine
    if they haven't they need to wait for the outcome first.

Not eligible for a payment arrangement 

  • *Ready for Perin 
  • *At Perin 
  • *At Summons 
  • *Summons Pending 
  • Pending Decision -The fine is under Council review. No action will be taken during this period. If the appeal is unsuccessful, then contact the Council for a payment arrangement.
  • Written Off status due to Interstate plates or NAT (national heavy trucks)
    Call CommAmenity Admin first to reinstate. Then, you can complete a payment arrangement. If they are busy or unavailable, email Regserv with the customer's details and inform them of the request. They need to activate the fine first and will contact the customer to finalize the arrangement.

What happens after a payment arrangement has been submitted by Customer Service?

Process:

Community Amenity team submits the referral to Fines Victoria within a few days. Fines Victoria will contact the customer by phone within 3 -4 weeks to arrange payment. The customer must wait for this step, even if the fine is overdue. We cannot take payment if they opt for a payment arrangement, even if they change their minds.

 

Additional charges on Fines

1. No additional fees will be applied when a Payment Arrangement has been submitted and accepted by Fines Victoria

2. We are unable to waive additional fees on fines, even if they provide reasons like, I didn't receive the notices
 

 

 

Can you submit the payment arrangement and then appeal the fine?

No, they need to appeal first and wait for the outcome before a payment arrangement can be submitted.

Can they pay in full and then appeal after paying in full?

No, appeal first and wait for the outcome. Then pay if the appeal has been declined. 

Lodged payment request actioned but have not been contacted by Fines Victoria yet?

CSO:

  • Check the status of the fine in P & R and it is PayArr- Fines Vic - Payment Arrangement. This means the fine has been referred to Fines Victoria. 

 

  • Advise the customer to wait until they get a call from them.
  • It is out of our hands until they contact them
  • They can't change their minds and pay Council, after it has been referred to Fines Victoria

 

Can they change their mind after lodging a payment arrangement and pay in full?

After a payment arrangement has been submitted, we can't retrieve it back. The customer will need to wait till Fines Victoria contacts them and they can request to pay in full with them.

Payment Arrangement made with Fines Victoria and customer wishes to make changes

If Fines Victoria have an arrangement, the customer must contact them quoting the Fines Victoria reference number.

Pay Arrangement broken with Fines Victoria - advised that the fine has returned to Council

If the payment arrangement terms are not adhered to, meaning they have not made payment as agreed.
Fines Victoria will forward the unpaid fine back to the Council. Individuals will be directed to contact the Council for further assistance.

If a customer calls as this has happened to them.

Nominate another individual/company

If you receive a fine you may be able to nominate another individual.

Not eligible to nominate when

Nominating another individual or Company

If you were not driving at the time of the offense, complete the form to tell us who was driving.

CSO: 

  • Email the form to the customer

  • When nominating an individual, you must provide the other driver's details.
  • If nominating a company, use the same form and enter the company name in the "Name" field. Ensure you include the company's ABN. If the ABN is unavailable, advise the customer to use ABN Lookup to retrieve it

Nominating an individual for infringement not related to parking

This applies to individuals only, who are incorrectly issued fines

Advise to send an email or send a letter to Council, advising

  1. full name and phone details of both parties, the person issued with the fine, and the nominated person
  2. Send the email/letter before the fine is due to be paid, allowing sufficient time for it to be received. If returned after this point, we will not be able to re-issue the infringement to the other person.

Company nominating individual

CSO:

Advise that a company can nominate an individual or company subject to the points below. They can only appeal a fine via the normal process after nomination.

Company Nominating an Individual 

Parking Infringements only:

  • A company may nominate a driver if the infringement relates to a Parking Infringement Notice.
  • The company must complete the standard nomination form (Operator Owner Onus Form).
  • Ensure the form includes:
    • Full company name
    • Company address
    • ACN/ABN number
  • Council will re-issue the infringement notice to the nominated driver.

All Other Infringements:

  • The company must advise the council on council@cgd.vic.gov.au if they were not responsible for incurring an infringement notice and will be contacted via email.

Company nominating another company

If a company wants to nominate another company that is responsible for the fine, they will have to complete the appeals form. Currently, the nomination form does not have a provision for this scenario.

Extension of time

Extention conditions:

  • Only one extension of time will be granted to a maximum of 4 weeks (excluding the one that comes with an appeal)

  • NOMD - infringe re-issued - Nominated driver
  • PayExt -Extension of Time – Payment - this one requires you to check the events of the infringement as they may have been nominated as the driver and now want to be an extension of time

  • Then go to the relevant center you at for the day to check the process

  • Ask the Centre Supervisor to issue the extension, if busy call the response group Infringement Ext Admin,
  • You will need the customer's name when you call through

Request to go to Court

How much does it cost to go to Court?

If the driver elects to take the matter to the Magistrates court, there is a Court lodgement fee that will be paid by Council on behalf of the customer.
Then on the day of court and is determined by the Magistrate, it is then up to the Judge to decide whether that amount is payable by the customer regardless if they win or lose.
The additional costs that the Council has incurred, will also be decided by the Judge if the customer should pay if they lose the matter.

When can you go to Court

The registered owner or driver can have the infringement matter heard at the Magistrates' Court any time before the fine is registered with Fines Victoria.

What do you do to go to Court

By law, you must have 'Legal Standing' to take a matter to court. 

Legal standing for parking fines is if you are:

  1. the registered owner
  2. a person who has been formally nominated as the driver
  3. a lawyer acting on behalf of the registered owner or nominated driver.

Legal standing for all other types of fines issued by Council, is if you are:

  1. the person named on the fine (or a director if the fine was issued to a company)
  2. a lawyer acting on behalf of the person, or company, named on the fine.

If you have legal standing and you want the matter to go to court, complete the form.

What happens after you apply

If your application to go to court is accepted:

the matter will be listed at the Magistrates' Court
you may need to appear before the court at a specified date and time (you'll be notified of your court date, time and location in the mail). This is called a hearing.
If you don't go to your hearing, the court can decide the matter in your absence.

View, email and print photos of parking fines

CSO:

  • Email link this link  PinForce Online to the customer to view photos of their fine, The infringement number and car registration will be required.
     
  • If they do not have email, then tell them to go to www.greaterdandenong.vic.gov.au and search the keyword parking infringement. 

Counters

The customer requests photos to be emailed or printed at counters

Use the Snipping tool or Greenshot to copy and paste the photos from PinForce Online into an email or Word document.

CSO: 

  • If you can use this method, go ahead and email or print a photo for the customer
  • Seek assistance from the Centre Supervisor or the Support Team if you are unable to do so
  • DO NOT request Regservices to provide this service. 

If Fines Victoria has notified the customer

If Fines Victoria has advised and confirmed the payment arrangement then customer needs to only deal with Fines Victoria

Fines Victoria has not contacted the Customer

If Fines Victoria has not contacted the customer, advise them to wait. 

Not received correspondence related to their appeal

If the fine offender advises that they have not received correspondence related to their appeal, do not provide them with any document found in Objective. Email Community Amenity to resend the documents to the customer.

Using the phone message template, provide the customer with full details, including email address, street address, and phone number. With a clear explanation of the issue
